Probate is a legal process by which the assets of an estate, including real property, are distributed to the heirs.Under the supervision of the court, legal title to the real property may be transferred to a buyer. The sale is highly regulated and monitored, with procedural requirements, specific disclosures and critical deadlines. The goal of the sale of the real property is to benefit the estate.

The title to real property can be held in trust for the benefit of one or more other persons or entities, known as the beneficiary.The trust is controlled and managed by a trustee, who may or may not be the same as the beneficiary. When real property is sold through trust, the proceeds from the sale are designated for the welfare of the beneficiary. Regulated by state law and often requiring court proceedings, a trust sale needs astute management to safeguard the assets for the long-term benefit of the beneficiary.

When an individual cannot manage their own care or assets, the court may appoint a responsible party as conservator.The conservator’s fiduciary responsibility may require the sale of real property for the benefit of the conservatee. As with trust and probate proceedings, the sale of real property through conservatorship is a closely monitored legal transaction.
