A perpetual easement is reserved over, under and through a portion of the property fifteen (15) feet in width measured from the edge of the road right-of-way, the same for the purpose of construction and maintenance of utilities to service this property and other properties lying adjacent thereto with the rights of egress and access and for the maintenance thereof and no structure of any kind shall be erected or maintained over or upon said easement except those necessary for utility purposes. 2. The property herein conveyed shall not be further divided or subdivided nor shall any accumulation of further property added to the property herein conveyed be divided or subdivided into parcels smaller than those making up the accumulation. 3. No structure shall be built nearer than sixty (60) feet from the centerline of the road on the front lot line of said property. No mobile home shall be set and used as a temporary or permanent residence upon the property herein conveyed; provided, however, that modular and double wide homes permanently fixed and set upon a foundation upon the said property shall be excepted. 4. If any of the parties hereto or any of their successors or assigns violate or attempt to violate any of the covenants or restrictions set out herein before January 1, 2031, it shall be lawful for any other person or persons owning any lot which is a part of the property hereinbefore referred to, to prosecute by proceeding a law against the person or persons violating or attempting to violate such covenants or restrictions and either to prevent them from so doing or to recover damages or other dues for such violations. 9. Should any of the restrictions and limitations contained herein or in other deeds be invalidated by judgment of any court, then the validity of all other provisions not affected by such judgement shall continue to remain in full force and effect. The foregoing restrictions and conditions shall be covenant running with land and be binding on all successors in title to the said real estate.
